Exceptional Student Education is referred to student’s who have either a current IEP (Individual Education Plan or a current 504 plan.
Students with Disabilities (Full-Time Enrollment)
Duval Virtual Instruction Academy does offer a full-time program, as a school choice option, by application to the program. Upon a student’s acceptance into the program, Duval Virtual Instruction Academy will become the school of enrollment, and be responsible, along with the district, for any IEP or 504 Plan that the student may have. In this case Duval Virtual Instruction Academy is both the student’s school of enrollment, and school of instruction, and becomes accountable to, and for, the student.

Students with Disabilities (Part-Time Enrollment)
“Part-time” virtual Instruction is a choice afforded to Florida students however, it should only be considered if it is an appropriate choice for the student and his or her educational needs.
Depending on the student’s school of enrollment, parents, guardians, or school counselors are responsible for submitting a student’s current IEP or 504 Plan.
There are many accommodations that are already included in the virtual instruction environment. Other accommodations are not possible in virtual education. Rarely, but on occasion, there may be an additional accommodation afforded to a student upon request, if it applies within the virtual instruction parameters.
Students with IEP’s and 504 Plans enrolled as a “part-time” student in virtual instruction must receive plan related services, from their tradition school (school of enrollment) and/or their district of enrollment. Parents, guardians, and school counselors are encouraged to communicate with their virtual instruction school and/or their student’s teacher(s) to determine whether the virtual instruction setting can meet the educational needs of the student.
Most virtual instruction courses do offer a “grace-period” (14-28 days) for students and families to decide if virtual instruction is an appropriate student fit. Please be sure and discuss the limitations this “grace-period” may offer with your student’s teacher and/or the school.
Students with Disabilities (Home Education Student)
If you are homeschooling a child with special needs, you need to follow Florida’s homeschool regulations. There are no additional requirements for homeschooling children with special needs.
Home education students are eligible for testing and evaluation services at diagnostic and resource centers, in accordance with Florida Statutes § 1006.03. See Florida Statutes § 1002.41(9).
However, once an evaluation is done and the child has been identified as having a disability, state law does not obligate the local school and/or district to provide services. If the child is enrolled “full-time” at a school within the district, the district will be obligated to provide a free appropriate public education (FAPE) to the child.
